Isabella County Tenants Beware! Sheriff's Department Can & Will Evict You Without Due Process!
Cause and Effect The actions taken against my family have been decimating. Imagine, if you will, going to your home tonight and finding your key no longer works in the lock. It doesn’t matter if you are renting or own your home. Just imagine if you can what your life would be like if you were denied entry to your home after coming home from work. What would you do? What could you do? For many people, people in good standing and financially fit, you might go to a hotel and worry about it in the morning or call the lawyer you have on your speed dial right? This is what I would have done a couple years ago. Now imagine that you were coming home after a long day of looking for work and you had used money for gas that you couldn’t afford in the first place to find that your key no longer worked the lock on your home. What do you do then? Now imagine that everything you had in your house is now gone forever and that you will never again see, touch or feel anything that had once been yours. Now imagine that the cop you called came to your aid and told you that this was the way it was supposed to be. Sorry bout your luck! Now get lost or I will arrest you for trespass! Lockouts are a crime for a reason. Lockouts hurt people. A lockout is one person exacting justice upon another person without the law or due process. Lockouts are a form of vigilantism. Cops come and tell you, “Sorry about your luck”. You’re a trespasser on your own property so leave or be arrested. So after your family is decimated by the event itself we need to go and find justice where? Law enforcement’s involvement in our issue was the largest part of the problem so where do we go? I will post the reply of every organization we have contacted for help. What you will see is that all of the obvious courses of action go nowhere. There are a multitude of outreach programs available to families that have lost everything in a house fire but there are none for those who have lost everything that have been wrongly accused of being behind on the rent. A very special thanks to the Salvation Army this last month for bringing me a delivery of propane to heat my house. I have a new found appreciation for that bell that rings outside department stores and grocery stores and can never imagine looking at that little red pot ever again in quite the same way. This website is the only thing we can do. It is our only recourse. The police find this amusing. They know that launching a campaign for justice is entirely an uphill battle and that if we are able to hold them accountable it will be years away. No immediate threat. Fortunately I can build a website. I can put the truth online and help make people aware. I asked Sheriff Leo Mioduszewski to take an active participation and his response was this.
What did I want? What was I after? I wanted to make him aware. I wanted him to see and to recognize a deficiency so that he could become part of the solution instead of part of the problem. I wanted him to take a look at how something like this could happen in his department. I wanted him to help change the way officers respond to issues like this. But what is his motivation? Agreeing with me guarantees the potential of ownership of liability. Blowing me off buys him and the Sheriff’s Department time during which time I might lose motivation, courage, strength, ability and become completely succumb to destitution. He knows that I am bringing a pencil to a gunfight and that my odds are incredibly overwhelming. His solution is to further deny accountability. He already knew that we got absolutely nowhere with any other law enforcement agency yet saw it as the perfect opportunity to bow out, to stop communicating with us and to shut us out. As a business owner I understand the strategy but I absolutely do not agree with the morality of it. No other law enforcement agency is available to me to take a look at this. They all serve to protect their own first. There is a good reason that the majority of reports of Police misconduct go unreported as there isn’t really a safe way for citizens to do it! I am supposed to fight now that my only monthly income is derived from my military disability at $243.00 per month for being injured in the line of duty and thank God for that as the first thing paid is my access to the Internet at $80 per month that allows me to put this story on the Internet. I have been unable to find a lawyer that is willing to finance my case for what could and would be the next two or three years even though there are provisions that attorney fees may or may not be awarded at the end and the amount awarded, if any, are at the sole discretion of the judge presiding. Go figure! Another thing that I have to look forward to is the fact that Pro Se plaintiffs are definitely denied any fees for fighting a successful battle in a court of law. My option there is to fight for two or three years with no compensation for my time and effort. We can and will fight this battle Pro Se because it needs to be fought. It is our only option from where we stand. It is the moral thing to do. If we can keep one family from having to suffer these indignities and go through what we just went through at the hand of ignorance it will have all been worth it. There are other problems we will be addressing along the way. The total and complete lack of police officer accountability is just one. Compensation to lawyers who take on cases like this need to have no doubt that they will be compensated at the end regardless of the hourly wage they charge. When you are a check writer, finding a good lawyer is easy. When your monthly income is $300 a month lawyers tend to look the other way. They have to eat too! Effect: The effects of the recent events in my life have been life altering to say the least. There is not one single shred of similarity in my life that I had before this happened to us. Every single thing is different. It took me over two months to find someone on the Internet that was willing to take my rife in trade for a vehicle only to get it and have the brakes go out the very next day. It was a good trade though and I am fortunate now to be able to leave my prison. After pawning a couple of handguns I have been able to pay for new brakes. It is both sad and interesting to me to search the internet and find where other champions of justice on the Internet have done similar things. What shocks me is though is that I have noticed that they have all achieved some level of justice for their own cause and then walked away from the fight. I differ in this regard. I was among the many that used to take for granted a great many things. I have never been one to have trouble with law enforcement… Now I don’t have law enforcement. I could face an armed assailant tomorrow and not expect to call the law and actually get a response. After failing to get a PPO against Deputy Steinert he told me on the courthouse steps that I shouldn't worry because he was never ever going to have anything to do with me or my family ever again. This is not his discretion! Our law enforcement officers should not have the personal discretion to serve or not to serve the citizens of this or any other lands! It was for this very reason that I had requested the PPO in the first place. My family did not elect this self proclaimed Judge, Jury and Executioner into office. The effect… I have changed careers. It is my mission now to become a leader to those that have been abused by law enforcement. This isn’t a part time gig for me. At 44 years old this is now a fight that I will fight to the end of my days and when I am gone, what I have created will survive me and continue to support and defend others. We will become a training institution that instructs the police on how to do their jobs without trampling all over the civil rights of the citizens they have sworn to protect and to serve. These and a great many more topics needs to be on top of the stack and very actively pursued and seen through to fruition. Deputy Steinert told me that any landlord can lockout any tenant without Due Process and he is still out there! Serving us? Deputy Steinert claimed to be my family's Judge, Jury and Executioner and that there was no one that could or would reverse his decisions. How many more Sheriff's Deputies are out there with the same training and the same attitude serving us? One State Trooper I talked to said that I would be within my rights to open the house with a chainsaw if that is what it took to regain entry to our home. Why wasn't he the one to respond to our call for help? Through education and training, many of these problems can be overcome. I have been quoted a minimum of $25,000 dollars for a retainer to initiate our complaint. Although lawyers fees may be reimbursed in the end, the destitute family needs to front the costs. Just imagine how much more accountable law enforcement would become to the citizens they have sworn an oath of protection and service if Justice was truly accessible to all citizens regardless of their individual means.
